Membership Terms

1. Membership

By registering you will become a member of Durban Poison® Official Research Store.

2. Agreement

2.1 The following terms and conditions govern the use of this website, which is owned and operated by Durban Poison® Official, an initiative of the iNkosi yeSativa™ Co-operative.

2.2 The website is an online, private membership portal that provides verified adult members access to cannabis and cannabis-derived products — including flower, vapes, oils, edibles, health and therapeutic products — sourced from verified manufacturers.

2.3 By registering on the website and/or accessing and/or using the website, the member hereby agrees to be legally bound by this agreement, regardless of whether the member has expressly signed or assented to the terms and conditions contained herein, and in particular confirms that they are of the minimum age of 18 years and that accessing and purchasing cannabis products is permitted in their jurisdiction.

2.4 If the member does not understand this agreement, it is their responsibility to contact Durban Poison® Official for clarification before accepting the agreement or continuing to use the website.

2.5 The member must not use the website if they do not agree with the terms and conditions contained herein.

3. Use of the Website

3.1 To register as a member, the member must provide Durban Poison® Official with relevant information and personal details filled in on the membership form on this website. Upon validation of these details, Durban Poison® Official will provide the member with access to the members-only product range.

3.2 Members may only access the members-only section of the website after successful registration.

3.3 The member agrees to notify Durban Poison® Official immediately upon becoming aware of or reasonably suspecting any unauthorised access to or use of the member's credentials and to take reasonable and necessary steps to mitigate any resultant loss or harm.

3.4 Durban Poison® Official reserves the right to terminate unconfirmed and/or inactive accounts, and in its sole and absolute discretion to refuse or to terminate all or part of its services to the member for any reason whatsoever.

4. Duration

4.1 With effect from the registration date, the parties shall be obliged to perform on the terms and conditions of this agreement, unless terminated prior thereto by virtue of the expiry by effluxion of time, lawful termination or withdrawal; or on at least 2 (two) months' written notice by the member to Durban Poison® Official; or in accordance with the terms of this agreement.

5. Services

5.1 Durban Poison® Official operates a cannabis product research and retail service on behalf of its members. Products available include CBD (full spectrum, broad spectrum and isolate), CBG, CBN and THC, including dried flower, seeds, oils, extracts, vapes, edibles, health and therapeutic products, and selected pharmaceutical-grade cannabis medicines where available and permitted by the member's local jurisdiction.

5.2 Durban Poison® Official warrants that it shall perform services with utmost care and professionalism; take all reasonable precautions to guard against any loss to the member; ensure that services are carried out in accordance with industry best practices; and respect members' right to privacy in accordance with applicable data protection legislation.

6. Member Obligations

6.1 The member shall:

6.1.1 Submit to Durban Poison® Official such information as may reasonably be required from time to time in connection with the business of Durban Poison® Official.

6.1.2 Comply with all applicable laws, regulations, by-laws, ordinances, judgments and/or regulations in their jurisdiction in respect of the ownership, purchase, consumption and use of cannabis products obtained through this website.

6.1.3 Not on-sell or trade in the cannabis products purchased through this agreement, nor use them for any commercial or other gain. All products are for the member's own personal use and consumption only.

7. Waivers & Indemnity

7.1 Durban Poison® Official does not warrant any specific level of strength, potency or concentration in respect of cannabis products beyond what is stated on product packaging.

7.2 The member hereby indemnifies Durban Poison® Official and its agents and holds them harmless against any and all claims of whatsoever nature and howsoever arising in relation to the use, possession or transport of cannabis products obtained by the member through this website.

7.3 Neither party shall be liable for any consequential, indirect, general or punitive damages arising in terms of this agreement.

8. Limitation of Liability

8.1 The use of the services provided by Durban Poison® Official is entirely at the member's own risk and the member assumes full responsibility for any damage or loss resulting from the use of the services.

8.2 Durban Poison® Official shall not be liable for any direct, indirect, incidental, special or consequential loss or damages which might arise from the member's use of, or reliance upon, the services.

8.3 The member hereby indemnifies Durban Poison® Official, its employees, agents and authorised representatives and holds any and all of them harmless against any claim, charge or criminal prosecution which may arise as a result of the member utilising any cannabis product to deal, trade, distribute or acquire any illegal substance or product.

9. Privacy

9.1 Durban Poison® Official is committed to protecting the privacy of its members in compliance with applicable international data protection legislation.

9.2 Personal information collected at registration is used solely for the purpose of membership administration, order processing, and research data collection. All research data is transactional and anonymous — it concerns products, not people. Personal details are never sold, rented, shared with third parties, or used for any purpose other than membership administration.

9.3 Members may request access to, correction of, or deletion of their personal information by contacting Durban Poison® Official via the Contact page.

10. Governing Law

10.1 This agreement shall be governed by and construed in accordance with generally accepted principles of international commercial law. Durban Poison® Official is an initiative of the iNkosi yeSativa™ Co-operative, registered and operating under the Co-operatives Act of South Africa, but membership of the Research Store imposes no obligations on the member beyond those stated in these terms.

10.2 The member is solely responsible for ensuring that their purchase and use of cannabis products through this website complies with the laws of their own jurisdiction. Durban Poison® Official accepts no liability for any breach of local law by the member.
